Employer & Job Offer Requirements

OINP Workforce Priority Stream

To qualify under the Ontario Workforce Priority stream with a job offer, your employer must meet all the employer and job offer requirements below.[cite: 2] The employer must also have their application for an approval of an employment position approved in order for your application for a certificate of nomination to be approved.[cite: 2]

Employer Eligibility Criteria

Your employer must meet the following requirements:[cite: 2]

  • been in active business for at least 3 years prior to submitting the application[cite: 2]
  • have a business premises in Ontario where you will work[cite: 2]
  • have no outstanding orders made against them under the Ontario Employment Standards Act, 2000 or the Occupational Health and Safety Act[cite: 2]
  • meet revenue requirements based on the location of your job offer[cite: 2]
  • have a minimum number of Canadian citizen or permanent resident full-time employees based on the location of your job offer[cite: 2]
  • demonstrate that enough effort was made to recruit a Canadian citizen or a permanent resident prior to offering the position to you (this only applies if you are currently living outside Canada or working outside of Ontario)[cite: 2]

Job Offer Requirements

Your employer's job offer must:[cite: 2]

  • be for a full-time and permanent position in Ontario[cite: 2]
  • be urgently necessary to your employer's business[cite: 2]
  • not affect a labour dispute[cite: 2]
  • meet the required wage level based on the location of your job offer[cite: 2]

Self-Employed Professionals Exception

Self-employed professionals or those with other contractual service arrangements where there is no legal employer-employee relationship are not eligible to apply under the Ontario Workforce Priority stream, with the exception of self-employed physicians.[cite: 2]
